A felony conviction can have drastic consequences for years afterward. Criminal convictions may be vacated under certain circumstances. See RCW 9.94A.640. In addition, the Washington State Supreme Court recently invalidated the felony statute regarding simple possession of controlled substances in the landmark case of State of Washington v. Blake. If your conviction is for felony possession of controlled substance(s), you are entitled to vacation of your conviction and refund of any fees or fines. Washington State and Federal Constitutional Guarantees protect citizens from government over reach in a wide variety of areas. The right to life, liberty, and the pursuit of happiness, protection from undue government intrusion into private affairs, and enumerated human rights are all contained in the United States and Washington State Constitutions and case law. The Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, religion, sex, or national origin. You need a lawyer with a solid grasp of constitutional law to recognize and take action against unlawful government action.
